A young woman in prison for a second time for drunk driving related charges was back in court Monday morning.
The hearing for Tia Gerstner was over surcharges and her claims she doesn’t have any money. Gerstner asked the judge to drop $300 worth of surcharges until her prison term ends. Her attorney says it is so she can use her money to buy things like toothpaste and toothbrushes. The judge denied the request.
Gerstner is serving time for a felony DWI and a probation violation which stemmed from a 2009 crash that killed her friend and Aquinas classmate Joseph Mueller. She is serving 2 1/3 to 7 years in prison. Her attorney says the earliest she can get out of prison is 2015.
